Open Agreements Act

This bill adds a new code section,  O.C.G.A. ยง 50-18-78 to Article 4 of Chapter 18 of Title 50 of current code to prohibit any state agency from entering into a nondisclosure agreement, which is defined as any contract or instrument that prohibits two or more parties from disclosing any communications, terms, conditions, interactions or agreements between or among the parties to such contract or instrument.

Further, all agencies must fully disclose without delay any such terms of any agreement, incentive, or offer made or entered into by the agency.  Additionally, any citizen of this state may initiate a civil action to enforce this Code section and compel disclosure of those matters covered under a nondisclosure agreement entered into in violation of this Code section.
